WAIVER AND RELEASE AGREEMENT

LA RED DE HISPANOS

WARNING OF RISK, WAIVER OF LIABILITY, AND RELEASE OF CLAIMS

In consideration of being allowed to participate in La Red de Hispanos events and Heylo group, whether in-person, online, or hybrid, and access resources (both free and paid) provided by La Red de Hispanos located in Toronto, Ontario, I, the undersigned non-member participant, acknowledge and agree to the following:

1. Assumption of Risk: I understand that participating in La Red de Hispanos events and Heylo, whether in-person, online, or hybrid, and utilizing the provided resources may involve certain risks, including but not limited to physical injury, emotional distress, property damage, and other potential hazards. I acknowledge that the information provided by different sources may vary and I voluntarily assume all risks associated with my participation and the information received. I am voluntarily participating in these activities with knowledge of the danger involved and agree to assume any and all risks of bodily injury, death or property damage, whether those risks are known or unknown.

2. Waiver of Liability: I hereby waive, release, and discharge La Red de Hispanos, its owners, directors, officers, employees, agents, and representatives from any and all claims, demands, actions, causes of action, or liabilities of any nature whatsoever arising out of or related to my participation as a non-member in La Red de Hispanos events and Heylo group and the use of resources provided by the company. This waiver includes, but is not limited to, injuries, damages, losses, liabilities, costs, and expenses, whether arising from negligence, breach of contract, or any other legal theory. I understand that negligence includes failure on the part of the staff or affiliates of La Red De Hispanos events and Heylo group to take reasonable steps to safeguard or protect me from the risks, dangers and hazards of the activities referred to in this agreement.

3. Indemnification: I agree to indemnify and hold harmless La Red de Hispanos and its affiliates, officers, directors, employees, and agents from any and all claims, actions, demands, liabilities, losses, damages, costs, and expenses, including attorney's fees, arising from or related to my participation as a non-member in La Red de Hispanos events and Heylo group and the use of resources.

4. Medical Authorization: I authorize La Red de Hispanos and its representatives to obtain medical treatment for me in case of emergency or injury during La Red de Hispanos events.

5. Publicity Release: I grant La Red de Hispanos permission to use my likeness, voice, and any photographs or recordings taken during La Red de Hispanos events for promotional and marketing purposes without compensation.

6. Personal Responsibility: I acknowledge that I am responsible for my own health, safety, and well-being during La Red de Hispanos events. I agree to follow all instructions and guidelines provided by La Red de Hispanos' representatives.

7. Information Acknowledgment: I understand that La Red de Hispanos events and Heylo group may provide resources that may provide information coming from various sources, and there may be differences in the information provided. I acknowledge that it is my responsibility as a non-member to assess and verify information as needed and to make informed decisions based on the available information. In entering this agreement, I am not relying on any oral or written representation or statements made by La Red de Hispanos events and Heylo group staff or affiliates with respect to the safety of any activities provided or falling under this agreement.

8. Legal Jurisdiction: Any litigation involving the parties to this agreement shall be brought solely within the Province of Ontario and shall be within the exclusive JURISDICTION OF THE COURTS OF THE PROVINCE OF ONTARIO.

9. Consent: I hereby grant La Red de Hispanos on behalf of myself, my spouse and on behalf of my child(ren)/, the irrevocable right and permission to collect my private information such as use any interview statements from me in its publications, advertising or other media activities (including the Internet) and also to photograph and/or record me and to use the photograph and/or recording for all purposes, including advertising and promotional purposes, in any manner and all media now or hereafter known, in perpetuity throughout the world, without restriction as to alteration. I waive any right to inspect or approve the use of the photograph and/or recording and acknowledge and agree that the rights granted to this release are without compensation of any kind.

I certify that I am at least eighteen (18) years of age, medically and mentally sound and physically fit to participate at La Red de Hispanos group of Heylo and events and am competent to enter into this waiver and release agreement. I have read and understand this waiver and release of liability, and I voluntarily agree to its terms. I acknowledge that I am giving up substantial legal rights, including the right to sue La Red de Hispanos. I am aware that this is a release of liability and a contract between myself/my family or the minors for which I am responsible for and I sign this agreement of my own free will. I have had the opportunity to consult with legal counsel prior to signing this waiver if I so desired.
